GENERAL TERMS & CONDITIONS
Benzinger's Clothing Care reserves the right to refuse cleaning of any garment. Stain removal is not guaranteed, as outcomes depend on the garment's color, age, material, and structure, as well as the stains type, age, and prior treatment. Pricing provided by phone, text, or email is an estimate only; final pricing cannot be confirmed until the item is assessed in person. Additional charges may apply for stain treatment, specialty fabrics, oversized items, odor removal, or extraordinary cleaning requirements. We reserve the right to retain goods until payment is received in full.
RECLEAN POLICY
All requests for recleaning must be initiated within 14 days of the date of pick-up at the counter or delivery.
Garments must be unworn and include original dry-cleaning tags; household items must be in their original packaging. We are not responsible for damage caused by improper storage. Recleaning will not be performed where the reported issue constitutes cleaning-related damage; such matters are handled under our Damages Policy. Customers are encouraged to inspect all items at the time of pickup or delivery and notify us immediately of any concerns.
DAMAGES POLICY
Damage must be reported within 14 days of pickup or delivery. Garments must be unworn with original tags; household items must be in original packaging. We are not responsible for damage caused by improper storage after pickup or delivery.
Our staff may note visible wear or damage at drop-off, but we are not liable for the worsening of pre-existing conditions, including fabric weakness, discoloration, shrinkage, insect damage, or defects from age, manufacturing, or normal wear. The dry-cleaning process involves unavoidable mechanical action that may affect weakened areas not visible prior to processing. We are not responsible for damage to items without care labels, or for items cleaned in accordance with manufacturer instructions. Certain garments contain unstable dyes, adhesives, trims, prints, coatings, or mixed-material construction that may react unpredictably to cleaning despite adherence to care-label instructions. We are not responsible for damage resulting from manufacturer defects, hidden defects, or normal wear.
Our liability for loss or damage shall not exceed ten (10) times the cleaning charge for the affected item, regardless of brand or condition. We follow International Fabricare Institute (IFI) guidelines and may consult the Dry Cleaning and Laundry Institute Textile Lab when necessary. We are not liable for indirect, incidental, consequential, or special damages, including lost income or missed events. Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot legally be limited under New York law.

MISSING ITEMS
Missing items must be reported within 14 days of pickup or delivery. Customers are encouraged to verify item counts at drop-off, as our intake records serve as the reference point for all investigations. Discrepancies should be raised at drop-off or within 24 hours of receiving your order confirmation. To file a claim, provide a specific description of the item, including brand, color, and size. We require at least 10 business days to investigate. Our liability for any lost garment shall not exceed ten (10) times our charge for cleaning that item, regardless of brand or condition.
ALTERATIONS
Benzinger's Clothing Care employs on-site alterations specialists at the Hamburg location. We strongly recommend professional pinning prior to any alteration; pinning done by the customer is at their own risk, and we will not offer redo services or assume responsibility for irreversible alterations. Customers must review and approve all alterations and measurements before work begins. Measurements are considered accepted at the time of fitting unless concerns are raised beforehand. We are not liable for fit issues resulting from changes in sizing, third-party measurements, or customer-provided specifications. Pricing is subject to change and will be confirmed at the time of service.
DONATION OF ITEMS
Items not collected and paid for within six months (180 days) are considered abandoned. In accordance with NY General Business Law §399-BB, Benzinger's Clothing Care reserves the right to donate unclaimed items to a bona fide charitable organization. All reasonable efforts to contact the owner will be made prior to donation, and notice will be posted in-store as required by law.
PERSONAL/LOOSE ITEMS
We are not responsible for loss or damage to personal items left in garments or garment bags, including money, jewelry, or other valuables. Please check all items before drop-off. If valuables are found, we will make reasonable efforts to return them, but we cannot be held liable for their loss. If a belt, pull tie, drawstring, or similar component is lost or damaged, our liability is limited to the value of that piece only, not the garment as a whole.
PROMOTIONS & SPECIAL OFFERS
Promotions, discounts, and special offers cannot be combined with other offers unless otherwise noted. Additional terms may apply. We reserve the right to modify or discontinue any promotion at any time.
CUSTOMER COMMUNICATIONS & TEXT MESSAGES
By providing your mobile number, you consent to receive transactional text messages regarding order status, delivery, pickup, and customer service. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP at any time to opt out.
PRIVACY & DATA SECURITY
Benzinger's Clothing Care protects your personal information in accordance with the New York SHIELD Act and applicable privacy laws. Information collected — including your name, address, phone number, and order history — is used solely to provide and improve our services. We do not sell or share your data with third parties for marketing purposes, and we maintain reasonable safeguards against unauthorized access or misuse. DELIVERY
Responsibility for items transfers to the customer upon delivery to the designated location, except in cases of gross negligence or willful misconduct. Delivery is evidenced by order scanning, GPS-verified location data, and photographs taken at the time of drop-off. Customers requesting unattended delivery assume responsibility for weather-related exposure, theft, or damage occurring after delivery is completed. Customers who provide a cell phone number will receive a delivery notification.
All delivery concerns — including condition disputes or non-delivery — must be reported within 48 hours of the delivery notification, where permitted by applicable law. To report a concern, text 716-646-8733 or call one of our locations.
PAYMENT TERMS & LATE FEES
Payment is due upon completion of services unless otherwise agreed in writing. Balances unpaid after 30 days may accrue simple interest at 1.5% per month (18% per year), or the maximum rate permitted by New York law, from the date payment was due. We reserve the right to retain goods until all balances, including accrued interest and fees, are paid in full.
FORCE MAJEURE
We are not liable for delays or failure to perform due to causes beyond our reasonable control, including weather, utility interruptions, labor shortages, transportation disruptions, or acts of God. We will make reasonable efforts to notify affected customers and provide an estimated timeline for resumption of services.
DISPUTE RESOLUTION
Both parties agree to attempt good-faith resolution through direct communication before pursuing formal legal proceedings. If unresolved, either party may request non-binding mediation through a mutually agreed-upon mediator in Erie County, New York. Mediation costs, if any, will be shared equally unless otherwise agreed. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
GOVERNING LAW & VENUE
These Terms are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of Erie County, New York.
SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
ACCEPTANCE OF TERMS
By using our services, placing an order, or accepting delivery, you agree to these Terms & Conditions. These Terms are posted at all locations, referenced on receipts and order confirmations, and must be acknowledged prior to confirmation for online or delivery orders.
